This Privacy Notice sets forth the rules applicable to the processing of personal data of users who are natural persons and use the Medicalgorithmics S.A. website (hereinafter the “Website”) and the rules governing the use of cookies. 1. Data controller
The data controller of your personal data is Medicalgorithmics S.A. with its registered office in Warsaw (02-001) at Al. Jerozolimskie 81 (hereinafter “Medicalgorithmics” or “We”).
2. Principles, legal bases and purposes of data processing
Medicalgorithmics applies the following data processing principles: lawfulness, fairness and transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity and confidentiality, accountability.
The provision of data is a condition to receive an answer to a submitted query and a failure to provide the data shall prevent the receipt of an answer. Data shall be processed for the purpose of answering a submitted query (legal basis: legitimate interest of the data controller), for marketing purposes (legal basis: legitimate interest of the data controller) and for the purpose of establishment, exercise or defence of possible legal claims, if any (legal basis: legitimate interest of the data controller). Data submitted via online forms may also be processed for the purpose of sending you commercial information via electronic mail. Data may be subject to profiling with the use of IT systems intended for data analysis for marketing and sales purposes, in order to customise the content of the information sent to the expected preferences of the recipient.
If data is processed on the basis of a consent, we shall ensure that your consent to the processing of your personal data within the framework of the Website is given by a clear affirmative act establishing a freely given, specific, informed and unambiguous indication of your agreement to the processing of your personal data. Consent could include ticking a box when visiting the Website, choosing technical settings for information society services or by any other statement or conduct which clearly indicates in this context your acceptance of the proposed processing of your personal data.
3. Data retention period
Data shall be stored until the provision of an answer to the submitted query, the expiration of the limitation period of possible claims and the unsubscription of the user from the mailing list.
4. Data recipients
Your personal data may be transferred to the subsidiaries of the data controller and/or to entities that provide to the data controller IT hosting and architecture services and/or marketing services, including CRM services and data analysis for marketing and sales purposes.
Your personal data may be transferred to the United States of America, which, pursuant to Decision of the European Commission of 12 July 2016 (EU-US Privacy Shield) is deemed a third country that ensures an adequate level of data protection. You may obtain a copy of the personal data transferred to the US. For that purpose, please contact our data protection officer.
5. Your rights
You have the right to request access, rectification, erasure, restriction of the processing and transfer of your personal data. You have the right to file a complaint with a supervisory authority and to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
You have the right to object to processing of your personal data which is based on legitimate interest of the data controller, or to processing of your personal data for marketing purposes, including profiling.
